Terms of service (CGU)

1. Purpose
These terms govern access to and use of the beServe AI inference gateway (the "Service"), operated by beServe, Belgium.
2. Account and API keys
- You are responsible for keeping your API keys confidential. Keys are shown once at creation.
- One account per legal entity. You must provide accurate information.
- You must be 18+ or have legal capacity to contract.
3. Acceptable use
You may not use the service to: generate illegal content, infringe third-party rights, generate malware, attempt to identify individuals (unless lawfully justified), or circumvent rate limits or access controls. We may suspend access in case of violation or non-payment, with notice where practicable.
4. Service description
- Inference is provided via OpenAI-compatible endpoints from Scaleway infrastructure in Paris, France.
- Model availability, context limits and rate limits depend on your plan and may evolve.
- Phase 0 availability target: best effort. This service is not intended for safety-critical use.
5. Pricing and payment
- Prices in EUR, HTVA, as shown on the pricing page. EU TVA applies where required; Paddle, as merchant of record, invoices accordingly.
- B2B customers with a valid intra-community TVA number benefit from reverse charge.
- Subscriptions renew monthly; manage or cancel via Paddle (our merchant of record).
- Payment failures may result in suspension after a grace period.
6. Data protection
We process personal data per our privacy policy. For B2B customers, a Data Processing Agreement (DPA) is available on request at legal@beserve.eu.
7. Liability
The service is provided "as is". To the extent permitted by law, beServe's aggregate liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect damages or loss of profits.
8. Termination
You may close your account at any time from dashboard settings. We may terminate for material breach with notice. Upon termination, your data is deleted per our retention schedule.
9. Governing law
Belgian law applies. Disputes fall under the courts of the district where beServe is established, without prejudice to mandatory consumer protections.
